Car parked mostly on my part of the driveway
Questioner
I bought a house with a driveway that is directly connected to the driveway of the neighbor. However, the largest part of the driveway is mine. I had the land registry come for this. The neighbor (incidentally, he is not the owner of the house in which he lives) claims to have an agreement with the honorary/previous occupant of my house, that he can park his car, a large bus, partly on my driveway. On the street, the municipality grants a free parking permit for 1 car. The neighbor has a bus and a passenger car. When transferring the house, I explicitly asked whether there was a right to my part of the driveway. That was not the case. The question is, can the agreement that a previous occupant made be terminated by the new occupant.Lawyer
I see two possibilities here: according to the Road Traffic Act, one is not allowed to park in front of an exit, and your neighbor hinders you in exercising your rights, if that is sustainable and annoying, then that can be considered a form of neighborly nuisance if you yourself cannot use your own land, and you can reclaim the land. If there was an existing right to continue this, then personal agreements are explicitly taken over and can be terminated with due observance of a reasonable period.Take the next step
