Building a house on shared land alone

Questioner

My ex and I have a plot of land together. Now my ex thinks it's okay if I build a house there by myself. I can't buy him out, so we thought about building rights. So that the house that I build on the land is mine. However, mortgage providers are now making this difficult. On what basis could they refuse the financing or can I arrange this differently?

Lawyer

This is due to the rights of the building owner. You could also consider leasehold. Have this part thoroughly investigated before you take it to a bank. The bank wants to be able to continue to exercise its rights in the event of non-payment or violation of other obligations. Such as foreclosure sale.
