Building a house on shared land alone

My ex and I have a plot of land together. Now my ex thinks it's okay if I build a house there by myself. I can't buy him out, so we thought about building rights. So that the house that I build on the land is mine. However, mortgage providers are now making this difficult. On what basis could they refuse the financing or can I arrange this differently?
