Gutter/property boundary What legal steps should I take?

I have been living in this house for a year now, my neighbor apparently has trouble with the new situation. I have spoken to him several times about a leaking gutter hanging over the property line. Now the water keeps flowing on my side. This overhanging gutter has probably been there for over 20 years. What legal steps should I take to get the neighbor to replace/repair the gutter and let the water flow to his side.
