Divorce, co-parenting but I absolutely do not want her to be registered with her father
Questioner
My ex and I are getting divorced and we have lived in Rotterdam for the past few years. We both have custody and authority over our 1.5 year old daughter. My ex is currently living with his parents in Gouda but is still registered at our address in Rotterdam. It concerns a rental house where we are both co-tenants so if he deregisters we can both continue living there. My ex would like our daughter to be registered with him in Gouda. He wants this so that she can go to school in Gouda later. I don't have a driver's license and Gouda is a long way from Rotterdam for me. I also really want my daughter to be registered with me. I feel more responsible for her than my ex-partner does and I think a child should live with her mother and not with her father. I am willing to agree to a form of co-parenting but I absolutely do not want her to be registered with her father. I would like to handle everything in a good way. I think it is important that there is no contested divorce and that we do everything in the interest of our daughter. Yet I am very afraid of my ex-partner and his mother because they know much more about these kinds of situations. I am not very good at it and I am afraid that my ex-mother-in-law and my ex-partner would very much like to raise our daughter together without my help. What should I do? And what are my rights? Can they demand that our daughter be registered with them? Or can I assume that she will remain registered with me?Lawyer
Dear, if you - during the relationship - were also responsible for the daily care of the child, then you can (normally) assume that the child will have her main residence with you. The fact that there now also seems to be social ties of the Child with Rotterdam also plays to your advantage! If you have any questions, please do not hesitate to contact me.Take the next step
