Rejection of home exchange

Unfortunately, I have been rejected for a house exchange with another tenant. Unfortunately, it is about the difference of €4000 gross per year. It is indicated that they are above the social rent limit. The house I want to exchange is a 5-room house, too big for me and my son, and the other reason is that I had a very serious car accident near my home and have to go to work and home every day, every day I drive past the scene of the accident, and often experience that I sit behind the wheel sweating. The other tenants have a 4-room house in 2 villages further and is too small for 4 people. Could we apply for this with a judge for substitution? I am not eligible for an emergency because of the car accident. This does not help my recovery. It is so hard to have to go there every day.

The landlord is entitled to set reasonable conditions for home exchange. A minimum and maximum income is a reasonable condition. Setting a maximum income protects the interests of a justified distribution of the stock of social housing. A judge will therefore never grant the claim for substitution in your situation.
