Payment terms for kitchen delivery
Questioner
We recently purchased a kitchen with the payment condition of 100% payment upon delivery. The total amount to be transferred upon delivery includes installation and connection. Our question is, should the amount be paid in full upon delivery and therefore before installation and connection, or can we pay this? also deviate from. e.g. 90% upon delivery of the kitchen (materials, equipment) and a remaining 10% after assembly and connection, because in principle assembly and connection are also part of the delivery, right? The payment condition we signed for, i.e. 100% upon delivery, can be interpreted in 2 ways. 100% upon delivery of the kitchen (materials etc.) or 100% upon delivery of the kitchen incl. assembly and connection. We assumed the second. Please advise on thisLawyer
Service is not part of delivery but an obligation based on a contract for work that is part of the (mixed) contract for the purchase of the kitchen. What has been agreed upon 100% upon delivery is done to prevent that you have not yet paid everything but the kitchen is part of your home through the rules of accession and durable connection.Take the next step
