Default after delivery of vessel despite commissioning conditions
Questioner
3 months after delivery of a ship I suddenly received a notice of default from Legal Expenses Insurer. At that time it was supposed to be about 2 points but the client had already made full use of the ship for 3 months despite the conditions for use that were provided upon delivery. Now we are 2 years further and Legal expenses insurer does not answer anything but suddenly the list is getting longer and longer. The worst thing I find is that the customer gets information from suppliers about orders placed by me without permission. Puts pressure on another company because they want names of witnesses. Legal expenses insurer does not respond to any substantive questions. Only with threats and amounts that really make no sense and cannot even indicate what the customer has actually paid. Fortunately, I have taken photos of everything and have all the correspondence that has been with the customer. In every response I refute every point but Legal expenses insurer really does not answer anything. Whether I want to transfer amounts within 14 days and well, they have also been increasing by thousands each time in the past 2 years. In the meantime, Legal expenses insurer has had 3 experts come. The last expert asked me for my side of the story and after explaining he indicated that being present at the ship was pointless. Of course, now received a whole new book and another enormous amount. But no response to the questions that have been open for 2 years. I myself am at the stage where a judge should make a decision here. Reasonableness is completely gone and Legal Aid Insurer keeps claiming that their client is the only one who knows and speaks the truth. How can I best respond to this because I am really done with it.Lawyer
