Can the seller keep the down payment if they decide not to sell?

On March 7th we bought a puppy via marktplaats. We have to make a deposit of 300 € (purchase price is 575 €). On March 24, we received a message that the purchase was not going ahead because she did not have a good feeling about it. So the seller breaks our agreement and now refuses to refund the deposit.
