How can a valid chain clause be enforced?
Questioner
The complex we live in is divided into apartment rights for commerce, living and parking. (Main association and three sub-divisions) The proof of ownership contains a number of chain conditions, including provisions regarding the loading and unloading of goods for the supermarket located in the commercial section. However, these provisions are being flouted and this regularly causes inconvenience. Can these provisions be enforced and if so, how?Lawyer
A chain clause is a way to impose obligations from an agreement on third parties who are not a party to the agreement. I do not fully understand the application of the chain clause to which it refers. Agreements between the various members of the VvE must be complied with. Sometimes the household rules contain fines for violations of the agreed agreements. If a member of the VvE does not comply with the rules, he or she can be held accountable by the VvE. If a VvE member behaves unlawfully towards another VvE member, the VvE member can take legal action against the other VvE member.
