Is severance pay €55,000 reasonable?
Questioner
62 years old, employment contract 37 years and manager. First of all: About 3 years ago I received a written warning (in my opinion not justified) Now one of my employees has emailed a negative letter about me to management, for which I had a meeting with the confidential counselor. Was approached in an aggressive manner (eg don't look so vague / they are adults / and I don't believe you) However, I was able to refute all the statements, so they had no reason to prosecute me. Now they want to make an arrangement with me: from the age of 63 I will receive unemployment benefits, whereby they will increase this for 2 years to the salary I earn now. In total they will reimburse 55,000 euros. I will receive this in writing next week. Is this fair and how should I proceed?Lawyer
In case of dismissal you are entitled to a transition payment (TV). The amount of this is regulated by law. On the internet you can find various calculation programs to calculate this (depending on age, length of employment and salary level). If the employer has acted seriously reprehensibly, you can also claim a fair compensation (BV). The amount of the BV is determined by the judge (or by mutual agreement). Given your story, it is good that you contact a specialized labor law attorney (member of a specialist association) as soon as possible, e.g. me. Often the first consultation is free, such as at my office.Take the next step
