Neighbors are installing a climbing tower/playhouse with swing and slide
Questioner
Hello, This weekend our neighbors started digging and setting concrete posts/frames for a playground equipment with climbing tower, slide and swing in their garden. It's nice for their children, we want that for them too. However, the posts may be just 1 meter from our fence. The plateau bottom would be around 120cm and the fence is 180cm. So the twins, 2 boys, will be able to look out over our fence and into our garden and into our back extension and the living room... Our dogs will also definitely bark when they see the children. We are also afraid that the dogs will be provoked and then cause a barking nuisance. Now the question is how can we stop this? So close to the property boundary and the height. We have already tried to text the neighbours, without result, he simply poured the posts into concrete today, after the request to stay 2 metres away from the property boundary. Please give your opinion...Lawyer
There is no legal prohibition to stay within a certain distance of the property boundary with a structure in the garden, but the height of it. It can be max 2.5. If what you fear happens, you could take action against it on the basis of unlawful nuisance to neighbours (which does not mean that it is unlawful, that must be proven)Take the next step
