What about the cooling-off period for terminating a purchase agreement?
Questioner
On March 24, at our request, we had a salesperson at home for plastic window frames. We then signed a purchase agreement of which what we discussed was not as nice as we had in mind. We subsequently opted for a different layout, but here too they can guarantee the wishes we have. We have decided to terminate the purchase agreement, on which they want to charge us 30% of the costs. Nothing has been ordered yet. So the frames have not been made yet. During the conversation with the seller, we were not told that we still have a 14-day reflection period and this is also not stated in the general terms and conditions. Now I read on the internet that if the seller does not report this or if this is not stated in the terms and conditions, the 14-day reflection period will be extended to 12 months. I would like to know if this is a point I can mention to cancel the purchase agreement.Lawyer
You are not satisfied with my previous answer but for the order for custom-made items this rule does not apply. And if the seller does not appeal to that then you do have a point. (but you better not give a reason for termination because if you do another rule comes into play, namely that of non-conformity)Take the next step
