What are my rights if I want to light the BBQ in my backyard?

Upstairs neighbor experiences nuisance from smoke from the BBQ and asks me to BBQ in public. I BBQ very little to none in a year. and still it is not appreciated at all. I have indicated that I am just going to BBQ and have informed the neighbor in advance.Lawyer
