How do I collect the amount of €6,430.89 from my previous employers?
Questioner
I have been informed by the trustee that the bankruptcy has been lifted due to assets. I had filed a judgment of 6430.89 these are vacation days and overtime which arose from goodwill. The contract clearly stated that the overtime and vacation days were paid at the end of the year. But because there was no money for it every time, we were asked for a postponement. When I wanted to take vacation it was always difficult difficult busy etc etc etc so there was always something. The UWV has neatly paid out a part over part of 2019 and part of 2020 but this is the remaining amount that is still outstanding. I just called the UWV and they told me that they couldn't do anything for me, so my hope in you has been confirmed. It's a lot of money that I worked hard for. It can't be that the gentlemen 1 with 2 expensive Rolexes and a fat Audi and the other with a princely house and king size car can continue like this and escape the dance. Waiting for your reply. Yours sincerely,Lawyer
Dear, I can indeed imagine that you would like to collect this amount. Would you please contact me without obligation so that I can discuss the possibilities with you?Lawyer
It is important whether your employer was a BV? Or a sole proprietorship, general partnership, partnership. In the first case, you will probably miss out. In the second case, your claim will remain and you can try to collect it for 20 years. Given your story (the gentlemen themselves still have a lot of assets), I fear that this is a BV. In that case, the gentlemen are only liable for mismanagement. Otherwise, they will - unfortunately - go free. Seek advice from a specialized labor law attorney (member of the specialist association). The first consultation is often free. Beware of people/lawyers who promise you the moon. Often, after the invoice (and payment thereof) disappointment follows.Take the next step
