Rental contract for rental term terminated. Do I have to pay the first month?

Questioner

I signed a rental agreement two weeks ago, effective July 1st. Now I was laid off last week (in May), which means I can no longer pay the rent. The notice period for the rent is one month and it is still more than a month until I would move in. The landlord wants me to pay the rent before July. Should I do that? (I have already transferred the first rent and the deposit to him). Thank you.

Lawyer

You give notice with a month's notice while you would not yet occupy the property. The notice arrangement gives the landlord the opportunity to find another tenant. Now there is one anyway. It is quite possible that the landlord will even find a new tenant for the same rental date. In that case he would enrich himself compared to the notice, and that is not desirable. That does not mean that you will automatically get your money back, that will be difficult without legal pressure, you can contact me for some help by email.
