Can my neighbor use our gutter to reach our solar panels?

Common gutter. between two mansard roofs. The neighbor uses this gutter to reach his solar panels. I want to insulate my roof from the outside. Then he has less space to stand in the gutter/walk through the gutter. How is this regulated by law? A gutter is not there to walk in.
