Is a rent of 300 legally valid, so that it offers rental protection?

Questioner

I am going to live together with my boyfriend. We are going to rent an apartment from a family member. We can rent this apartment for a family price of 300 euros. Does this relatively low rent (given the location and size of the apartment) offer us rental protection?

Lawyer

No, ultimately not in court: because this can be considered a form of user agreement, there is no market-conform price against it. You can, however, propose to pay the remaining part for x number of months in kind (for example, if there is still work to be done) and to include that in the rental agreement. However, if the apartment could yield 1300, this is also not really tenable.
