My lawyer is just plain lax!

I have a conflict with my ex-employer. They did not pay me sick pay for 3 months, because it was supposed to be chronic. After investigation with their company doctor, it turned out not to be the case. I really have/had 100% sick pay for the first 2 weeks, and then 70% of the net salary. Employer eventually agreed, but paid the net amount gross. They say they have fulfilled everything. Lawyer Rademj filed for summary proceedings. This was discussed with him at the beginning of May. Finally on May 26, message, application for summary proceedings is now being drawn up. So far nothing....When I ask something, or call, I am not spoken to by the lawyer, and correspondence via email is almost impossible, I get little or no answer to questions, and if I do get an answer, it is a very short one. Last email was on June 28: We are still working on the summons, which will probably be ready by the end of the week. So not.....I am always told that applying for summary proceedings takes a long time due to corona, but it takes a very long time. Then be clear and just say, I can't handle the work / don't have time for it / too busy / don't feel like it / other things come first etc etc. But don't keep anyone hanging.

Lawyer

Ask the lawyer to send the draft summons to you and the subdistrict court judge within 5 days. If he does not do so, or if you receive another evasive response, file a complaint with the Dean of the Bar Association in the district where the lawyer is established. The Dean will then mediate and get the case moving. You can also mention the name of the lawyer (they usually don't like that).
