How can I have the maintenance payments recalculated?

Questioner

I pay €412 in alimony to my ex every month. My son will now be 18 in January 2022. At the time, we combined the alimony for her and my son into 1 amount. We have been divorced for 13 years now. I want to have the alimony recalculated because firstly, I no longer have to pay for her and secondly, I have my own business, which has been running at a loss for 1.5 years and I can no longer afford this high alimony. I have to borrow money every month to be able to continue, but the costs are only increasing. My son will start a new 2-year BBL/BOL training course in September 2021. The first half year 5 days of school, the second half year 3 days of school and 2 days of internship/work. The second year 1 day of school and 4 days of internship/work. He will receive compensation for this, but he does not know how much. Can I have the alimony recalculated and how should I do that? Awaiting your reply, yours sincerely

Good evening, It is certainly possible to adjust the maintenance. The income of your ex-partner and son is also needed for the recalculation. After the recalculation, the maintenance can be adjusted in mutual consultation with your son. If you are unable to obtain the data, you may consider going to court. If you have any additional questions, I am available to help you. I will be happy to assist you. Yours sincerely, Karin van Doorn Alimony law attorney
