How is the amount of non-pecuniary damages affected by the degree of fault of the other party?

While getting out of the back of a tram, another tram drove into my tram from behind at full speed and I was thrown out of the tram. Then a severe concussion and now still recovering. I got out at a regular stop, there was no bridge, traffic lights or other traffic, so far incomprehensible that the driver drove into my tram hard on such a free lane. Was she looking at her phone? But the penalty determination is of course up to the judge who investigates this. But how does this affect the amount of my compensation and how does contact take place between the personal injury lawyer and the criminal judge?
