Am I the owner of the outer wall of my neighbor's extension?
Questioner
I have just bought a house and I am wondering if I am the owner of an outside wall that belongs to the extension of the neighbours. I am the 2nd owner of the house and during the construction the neighbours chose the option with extension. The entire outside wall of approx. 30 cm is on my land. The expansion joint is on the property boundary. On the cadastral drawing the outside wall is drawn as if it belongs to my land registry. I want to grow plants against the wall and want to attach some things to it (decoration). Of course without the wall losing its function. Do I have to do this in consultation with the neighbours or can I consider it as 'my' wall?Lawyer
Sometimes the right to grow plants against your neighbours' wall is regulated in an easement. You can check this in the deed. It is also possible that the wall is on your land and that your neighbours are appealing to acquisition by prescription. It is also possible that agreements were made at some point regarding overbuilding. In short: I cannot give you much of a substantive response without further information. You can also contact me directly, then we can discuss the possibilities.Take the next step
