Can shrubs be placed in front of the window?

Questioner

Next to my house is a path of about 75 cm wide so that I can reach my gutter for maintenance. My bedroom window is also there at a height of 1 meter. The path has been there for over 13 years and the window has also been there for 15 years or more. The new neighbors are removing the twig and indicate that it is their garden that runs to my wall. They also want to plant shrubs there. My house is a Veenhuisje with a low sloping roof on that side. Is this allowed?

Lawyer

Yes, unless a property right has been established or this arises from prescription regarding the path. Bushes and shrubs may not be 50 cm from the property boundary. If that is the case, they may not reach higher than a property boundary may be there. On the front yard that is one meter, on the back yard two meters. If you have to carry out work, then there is the ladder right. This gives you the right to carry out work on your own home while you can only reach it via your neighbours' land.

Questioner

Even if that means I no longer have any light in my bedroom?

Lawyer

Yes, because there is no question of limitation (of view) and the light is in your bedroom, a room that is considered less important in terms of reduced sun and daylight with regard to nuisance to neighbours than, for example, a sun terrace or a living room where people spend a lot of time.

Questioner

When does limitation period occur?

Lawyer

after twenty years

Questioner
