Payment within 7 days

Questioner

I have a question regarding the NS. I bought a monthly subscription in May of this year. I needed this for a short training course in the Randstad. In July I suddenly received an invoice from XYZ direct debit for a monthly subscription, I contacted the NS customer service and it turned out that the subscription continues automatically. This customer service employee did cancel the subscription immediately. I would have received reminders in my NS. I had taken my laptop away in June because it had been hacked and I had not yet received it back at the time of the invoice. I have not been able to view the reminders. I tried to see if the NS would forgive me the remaining amount because I normally do not use public transport and did not know that the subscription automatically continued. After waiting for a few weeks, I received an answer last Thursday, August 19, I had received reminders and had to pay within 7 days, with a payment link. I immediately responded that I could not get into my laptop because it had been hacked and that I could not check any reminders. I asked if this could be forwarded to NS again and if possible make a payment arrangement if the first one did not go. I asked again on 23 and now 25 August, no response. What can I do? Also regarding the 7 days. Thank you in advance for your time and response. Yours sincerely,

The reason you give is not weighty because you could have gained access to mijnns via another computer via the account. Is it a large amount? Otherwise you could make an arrangement with the collection agency.

Questioner

I don't have another computer, I had to wait until I got my computer back and after that I still couldn't get into myns, hotmail etc. I have already requested a payment arrangement 3 times since August 19, but have received no response at all.

Lawyer

I would demand that arrangement by email. I know that in these kinds of cases they simply expect you to try to log in to your account somewhere else. (at family mobile or an internet shop) The risk that a device is not available does not lie with NS. As a gesture of goodwill they could still do something, but the claim has already been handed over.

Questioner

What can I do if they keep ignoring me? Pay a part anyway?

Lawyer

Yes, because not paying or waiting compared to the claim is usually not worth it. I do not know the amount of the claim, but what you do not want is an increase in costs. Your argument that the computer was not accessible and therefore your account was not accessible, will not hold up in a lawsuit.
