Legal assistance in labor disputes

Questioner

My daughter made a big mistake last time. She is behind the cash register of a supermarket and has sold alcohol to a person who was not yet 16 years old. because there was also a liquor sales inspection that evening, she was the unlucky one. The manager published this fact that same evening, along with our daughter's name, on the supermarket's internal website. I confronted him about this but his response was, 'this is our policy' is he acting correctly or is this prohibited?

Lawyer

Dear questioner, It is possible that your daughter has given permission for this fact to be placed in the employment contract and the house rules, but it is not neat. The act could be unlawful but it is closely related to the consequences of possible damage and how long the fact is stated on the website. Incidentally, it does .mi no good to the company name to mention employees who have made a mistake once by name 'en public'.

Questioner

Thanks for the clear answer. My daughter won't suffer much damage because it's still a student job. It is annoying for her, but she has already made a decision to look for another job. The manager immediately wanted to fire her, but that stopped the director from giving her another chance. I'll definitely keep an eye on how long this stays on the site. What time frame should I consider for something like this?

Lawyer

I don't think a week anymore, actually I would demand that the fact be removed from a daily update, especially now that your daughter has accepted another job; imagine that the new employer changes his/her mind when he/she reads that? In my opinion the old employer no longer has a reasonable interest in maintaining his/her own policy in this case.

Lawyer

Mrs Martens, Because it is an internal site, according to the questioner, the public cannot take note of it. And according to the questioner, her daughter is still looking for a new job.

Questioner

What Mrs. Doomernik writes is correct. I will allow a week and then speak to the manager about this. I thank you both for the answers given. If there is anything else in this matter that I should/should not do, I would of course be very happy to hear about it. thanks again

Lawyer

I do not agree with the above: nowadays the public knows how to find the shops on the internet and there are often also actions exclusively for the internet user. It is different if the girl is mentioned by name on a non-public part of the website.

Lawyer

Dear Mrs. Martens-Ferwerda, There is a difference between the internet and the intranet. The questioner speaks of an internal site and therefore means the intranet and not the internet. The intranet cannot be viewed by the consumer, the internet can. You do not have to agree with it, but that is just the way it is. yours sincerely, Mr. J. Wassink

Lawyer

Dear Joop, that was also my last argument, so why still answer; that escapes me.
