Do I have to repay tuition fees to my employer?

Questioner

Hello, I had to stop my job during my probationary period due to personal circumstances. I did this after about six days during my probationary period. Now I have to pay back the study costs. I have no income and can't do that. But it also doesn't say anywhere that this arrangement already starts during the trial period. Can I do something about/against this?

Lawyer

If there is a legally valid contract between your employer and you regarding the repayment of the study costs, then the 'blameability' of why these study costs are incurred and reclaimed must be examined. Is it reasonable and fair that the employer pays these study costs himself, or the employee. According to your brief account, it was not the employer's fault and according to a ruling in 2010 by the subdistrict court, the employer can reclaim them from you. My advice to you would be, contact the employer and try to find a compromise.
