Web Hosting Liability: Get Answers!

Questioner

Our web host i3d has deleted all our data, this was done by one of their employees and they admit it. Because we do not have any local backups ourselves, the entire website and database have to be rebuilt. Now we only want 1 year of free hosting as a compensation. Can I hold them liable for the costs of rebuilding the website?

Lawyer

Yes, you can hold them liable, but the question is whether there are no general terms and conditions in which their liability is limited. If that is the case, then it could be that you have no or only limited claim to compensation or reimbursement.

Questioner

dear robert Thank you for your response. Isn't it also true that general terms and conditions must be reasonable towards the consumer?

Lawyer

True, but to be able to form a good judgment whether general terms and conditions are unreasonable, it is important to know the details of the case. Limiting liability in general terms and conditions is not unreasonable without further ado.

Questioner

Dear Robert, What details are needed to assess this?
