LBIO has made a calculation of child support, my ex is now coming with a lawyer
Questioner
At the beginning of this year, my ex and I had a calculation of child support made by the LBIO in mutual consultation. This was based on annual statements from 2020. This showed that I would have to pay her 4 euros per month, with the full care discount (joint parenting 40% - 60%, with me caring for the child 40%) applied. My ex has now hired a lawyer, who made a calculation based on my annual statement and that of my girlfriend 2020 (cohabitation contract), and on the basis of my ex and her partner (married) of 3 pay slips from 2021. This suddenly resulted in completely different amounts: lower salary of my ex (ill this year), lower healthcare costs for my children, and due to the difference in ability to pay, my care discount was suddenly not fully cashed in. Of course I will not cooperate with a calculation by a non-neutral lawyer, but how can these differences suddenly exist in, for example, lower healthcare costs for my children? Also, the calculation of my ex's lawyer suddenly contains complicated calculations about the children, percentages, etc. in short, impossible to follow. (situation: I and my partner (cohabitation contract) have 2 children aged 2 and 0, my ex and her husband (married) have 2 children aged 2 and 0, my ex and I have 1 son aged 7) Main question, how do I proceed with this?Lawyer
It is wise for you to hire a lawyer to defend yourself. If nothing is done, I expect that the lawyer will file a petition with the court and request the court to record this higher maintenance amount. Your own lawyer will be able to check exactly what is and is not correct in this calculation and whether the incomes of the partners on both sides should be taken into account at all.
