Am I entitled to retroactive salary?

Questioner

I signed my contract in November 2019, without checking. It turns out that I was wrongly classified in a much lower scale. Only now in October 2021 do we find out about this. But the employer does not want to pay retroactively, because it is their own responsibility. It is a contract with a collective labor agreement. Am I entitled to payment?

Lawyer

If an applicable collective labor agreement states that you should have been classified higher, you may have a claim on your employer for wages. If you would like to discuss your case further, please feel free to contact me without obligation. Any outstanding wages you will have to claim from your employer. You can then also claim the statutory late payment compensation. The limitation period for this is 5 years.
