What to do in case of unlawful entry into your (front) garden?
Questioner
Why am I not allowed to threaten a person who unlawfully remains in my front yard after several requests to remove himself with a walking stick to convince him, if necessary with 'appropriate force', that he should leave. PM stick therefore functions as a weapon when used as intended and is not used in the house but in the (front) garden. If the person still stands after 3x advances and I call the police, the police do not come. In my case this was the situation. The (big!) man, (I am a little guy of 80) took the walking stick and poked me 3 times in the stomach area, so I exploded and tried to physically push him away and I was slightly injured. The police were called and came, heard both parties where the man allegedly said that I had thrown the first punch. The police said that the stick was described as a weapon outside and I would therefore be liable to punishment, especially if I had actually hit with the stick (which did not happen, so I only threatened!) Very simply: you are not authorized to use force other than to defend yourself, others, or property of yourself or others against immediate unlawful assault. So defending against death, injury, or damage. That is called self-defense.Take the next step
