Floor laid: do I need to carry out a warranty?
Questioner
I did a bathroom renovation 3 years ago. I went back to the customer for 2 loose tiles and I re-glued them. After my delivery in 2018, another party carried out various works in the bathroom, a new bath, a wall, a shower window with door and a wall with a washbasin cabinet and a washbasin. Now the wall with washbasin cabinet with washbasin is on the tiled floor, this was done by another party after my delivery. Now the floor tiles are loose, but they are a quarter below the wall. Now my question is, am I responsible for the loose tiles (goes on 10 tiles). I verbally stated that I would give a 1-year warranty on my work before I received the quote and started the job. I'd love to hear from you. Yours sincerely,Lawyer
This is difficult to state off the cuff. You are liable - in short - if it is established that the looseness is due to poorly executed work. I do note that the delivery was 3 years ago. Furthermore, it is indeed the question whether the work of the other contractor may have (partly) contributed to the damage. If it were to come to proceedings, the judge would possibly appoint an expert who would have to advise on the question of whose actions the damage was due to. Moreover, from a legal point of view, the conditions on the basis of which you entered into the construction contract also play a role. Perhaps you can reach a settlement with the customer? That way you may avoid proceedings.Take the next step
