Ex wants access to home

Questioner

My father is going through a divorce because his wife had an affair for a year. My father also found out that she stayed alone to obtain Dutch nationality. She only recently obtained this. She also incurred debts that she refuses to pay. In addition, there are several reports against her. Theft of jewelry and money, theft of his telephone and SIM card and changing passwords for his Facebook and email, which meant that he no longer had access to his business. Now his wife has voluntarily left the house and taken all her belongings, including half of the household effects, and has left for an unknown address abroad. She refused to deregister and an address investigation is therefore underway at the municipality. An administrative fine has also been issued for this. She recently returned the passwords, the telephone and the SIM card at the request of the police. She has also promised to deregister. Now, after 2 months, she suddenly realizes that she will lose her UWV benefit because of the address investigation and she has said that she will come back and live at home again as if nothing is wrong. She has said that she still loves him and that she will always be his wife. While he clearly does not want to anymore and they have both already signed the divorce petition. She also said that if he takes someone else, she will beat her up. It is all very threatening. My father is already old (79) and his wife is 44. My father had the locks changed because he is afraid that she will do something to him in his sleep. He lives in a senior rental home and she is therefore a co-resident and is on the contract. My father is going abroad for a while because he can no longer cope with the situation. But she said that she will have the lock broken by a locksmith when he is away because she has 'rights'. Can she have the lock replaced by a locksmith when he is not home and then move back into the home?

Lawyer

In the divorce proceedings, the lawyer who is assisting him could also submit a request for interim measures to the court. In this request, among other things, it could be requested that your father be granted the right to use the home during the proceedings. If this request is granted, the ex-partner may no longer enter the home. In the divorce proceedings themselves, it will then have to be requested that the tenancy rights of the home be allocated exclusively to your father.
