Can I buy out part of the child support?

Questioner

My partner and I are separating. He is released from primary liability for the mortgage. We are not married and do not have a cohabitation contract. Only I cannot give everything. There will probably still be an amount of 30,000. We have agreed that he will give me 150 a month in alimony for our 11-year-old son. Now I was wondering if I can buy off part of that so that my debt to him is reduced.

Lawyer

No, legally that is not allowed, in any case the invalidity of the agreement can always be invoked. You can also make an acknowledgement of debt and pay off in an agreed manner, or does that stand in the way of a mortgage application?

Questioner

No, it doesn't get in the way, but I thought if I buy off 100 euros, that would save me 8,000 that I have to pay back. But then he gives 50 euros a month. What happens if he doesn't keep his agreement of 150 a month?

Lawyer

If there is a arrears in child support of two months or more, you can contact the LBIO or send your ex a formal notice yourself.
