How is it arranged with our own account during the time we are not yet divorced?
Questioner
My partner and I entered into a registered partnership six months ago, but we want to dissolve it for personal reasons. Now I work abroad and would like to deposit the extra money I earn (included in my salary) into my own account. My question is: Is this worth it or will it still end up being distributed and is it therefore a pointless action? GreetingsLawyer
If there is a community of property, you cannot simply set aside/keep money or property. Until the community is terminated, there is a joint estate. In principle, it does not matter in which account the money is located. This may be different if you both made separate agreements/conditions when entering into the partnership. Upon termination of a registered partnership, the estate ceases to exist at the time of: - submission of the request for dissolution of the registered partnership to the court; - conclusion of the agreement to terminate the registered partnership by mutual consent. This information can be found in article 1:99 BW. The same time is mentioned in the article on settlement clauses in article 1:142 Bw.Take the next step
