How to terminate a contract extension?

Questioner

I entered into a 1-year contract with an online marketing company. The purpose of the contract is to attract online clients. The contract clearly states 1 year and when entering into this contract, no word was said about possible follow-up steps. During the year this online marketing has not yielded a single client and in the last 3 months there has also been no work. One month before the contract expires I was approached by this company about next year. I indicated that there is no next year because it has yielded nothing and has cost a lot of money. I was informed that the contract is automatically extended by one year unless you cancel 2 months before the expiration. I have read all the letters of the contract again and unfortunately it is there. In small print at the end of the agreement. My question is; How can I terminate this contract. The collaboration has also been completely disrupted and what is most important, it has yielded absolutely nothing. Nice words, promises and the question how many clients would you like per month has completely missed the mark. I would like to hear from you if there is a glimmer of hope in this matter.

Unfortunately, tacit renewal is permitted for business contracts (unlike for consumers). In principle, this means that you are stuck with the extension. Of course, this does not mean that there would be no option left. For example, you indicate that the marketing company is no longer performing any work and that you are not seeing any results. It could then be argued that they are not fulfilling the agreement. You may then be able to terminate the agreement on that basis. Without additional information, it is difficult to give a more concrete answer. In addition, it sometimes helps if a lawyer contacts a company. That can have a deterrent effect and sometimes it is suddenly possible to come to a solution. Please feel free to contact me if you require legal assistance.
