Gym contract without use
Questioner
On February 22, 2020, I started a contract with a gym, which I concluded for 1 year with a cash payment. This gave me a discount. Due to personal reasons and choices, I decided to no longer work out at this gym, but I did not have any special contact about this or write a cancellation form. I thought that the contract would expire after 1 year and that it would not be extended. Apparently this did happen. The gym did send me reminders, but because the gym sent a lot of spam I didn't see this. now they have extended the contract from February 22, 2021 to February 22, 2022. I have not made any payment or used this period yet. What are my options? 1. Do I have to pay? 2. For what period should this be done in any case? 3. And would the tacit contract also be for the discounted price? Yours sincerely,Lawyer
Is your gym an association? Only then would they be allowed to extend your membership by one year. Otherwise, you can cancel monthly if your installments are paid monthly. Given the fact that you did not respond and did not exercise, you could still try to cancel the membership retroactively, but because you could and were allowed to exercise all that time, I do not think they will accept it. Ask what your cancellation period is for this membership.Take the next step
