Dismissal during illness

Questioner

I am a sick employee who is undergoing reintegration. I cannot return to my current position, which is why the occupational expert advised me to activate track 1b and track 2. I am suffering from a bore/burn-out with mental complaints. I specifically did not mention one reason as a reason for absence, and that is a romantic contact with my manager. Nobody knows about this. Although this may not be seen as a reason for illness, it has made it difficult for me to work with him and was the reason for my absence. I deliberately did not mention the reason to protect him. In the meantime, my second year is almost over and I believe that my employer is not meeting his obligations. According to them, adjusting my current position is not an obligation for the employer and, in addition, for other positions (track 1b) only positions of the same scale or lower are considered, where I believe that, given my level of education and ambition, positions of one scale higher than mine may also be considered. I believe that the redeployment scheme may also be read and filled in as I mean it. I am running into a wall and feel unfairly treated. I get the feeling that HRM also wants to get rid of me and therefore only does the minimum in terms of obligations. It does not help my recovery and actually worsens my complaints. I am about to resign because I feel unwanted. What is the right decision to make in this case?

Lawyer

It is advisable to hire your own lawyer to prevent yourself from resigning (because then you lose certain rights such as unemployment benefits) and to see if you can still reach an agreement with your employer, which could be in another position but possibly also with a termination agreement in which you will still be entitled to unemployment benefits and possibly also receive more money from your employer. If desired, you can contact us. We could assist you in this.
