How do I write an objection to DUO?

Questioner

For personal reasons (emotional damage) I want to leave my father out of consideration. However, DUO has rejected my request because the conflict is not “serious enough”. How do I ensure that DUO still approves my request?

Lawyer

I believe that there must be a permanent disruption between parent and child. You may be able to object so that you can strengthen your argument.

Questioner

There is indeed a big conflict between me and my father. My request also clearly states that it has been going on for years and that mental abuse has taken place. Yet the request is rejected, probably because it has not been looked at. Does it make sense to say that I am going to court if they do not want to approve my request?

Lawyer

It makes sense to file an objection and motivate that objection with, for example, a reference to case law and the law. If you want some help with this, you can contact me directly via info@rechtinjestad.nl

If you disagree with a decision by (in this case) DUO, you normally have 6 weeks to file an objection. There should be a reference to legal remedies in the decision. There you will also find the address where you can file an objection. The objection must contain at least the following elements: - the characteristic and a description of the decision, - a date (stating the day you drew up the objection), - your reasons why you disagree with the decision, - your details (including home address), - a signature with signature and name. You can also ask for the documents of the file. This can sometimes help to clarify why an application was rejected. In the objection procedure, you can also provide more information about your personal situation. It is possible that DUO will make a different decision based on additional information. Please feel free to contact me if you have any questions or require legal assistance.

Questioner

Good morning, how did you get 6 weeks? In my case it says I only have 2 weeks, which I find very short…

Lawyer

The standard term for filing an objection is 6 weeks. In specific cases, a shorter term may apply. Has DUO already indicated that they will definitively reject the application? Or have they given another chance to, for example, ask for more information? See also this link: https://duo.nl/particulier/oneens-met-duo/bezwaar-maken.jsp Standard text DUO Disagree with decision Do you disagree with a decision by DUO? Then you can file an objection. An objection always concerns the content of a decision, not the lack of a decision or the service provision. You must file an objection within 6 weeks after the date stated on the decision or message.
