Incorrectly sent summons for a hearing

Questioner

I received a summons for a public prosecutor's hearing for a traffic violation that I allegedly committed on February 21, 2021. I was arrested in early 2021 and received a fine and paid it, but according to my bank statements I paid it on January 21, 2021, so the violation must have been committed earlier. Could a mistake have been made here and the summons not intended for me or could it change something to my advantage if it was?

It sometimes happens that a mistake is made, or that a payment is not processed correctly, for example, which means that you are still summoned to a Public Prosecution Service hearing. If there is a mistake and you have already paid a fine for the same act, you cannot be punished again. It is important to bring proof that you have already paid a fine for the same act. However, it may also concern another fact, for example a speeding violation that was recorded by a camera or a police officer, but which you were not yet aware of. You can request access to the criminal file. You can also obtain access to the file via a lawyer or attorney. If there is an error, you can discuss this with the help of the file for the Public Prosecution Service hearing. In any case, it is advisable to attend the hearing.
