Reorganization
Questioner
I am 1 of 4 Service Field Managers at a large organization. I directly manage 35 service engineers. Business is going very well and we both significantly out. Now we want to focus more on the individual at the organization, but with all the work that is difficult in my current position. Today a plan was presented, with which we can (possibly) organize this. Concretely: from the 4 Managers we will go to 2 managers and Lead engineers will be given who will 'lead' a smaller group of mechanics. My position will be eliminated and in addition they have offered me a completely different position within the organization. I do not yet know whether I want to take on this position, but what are my rights and obligations in this? yours sincerely,Lawyer
It is good to think about what you would like. If you have accepted the new function, you are basically stuck with it. Would the function change a lot (in terms of content and conditions)? In such cases, a settlement agreement is usually also offered to separate. In such cases, entitlement to unemployment benefits arises (if the agreement is properly drawn up) and it is often possible to agree on a transition payment. In addition, it is of course always possible to negotiate the new function. However, a company has considerable room to provide insight into the business operations and to shape a possible reorganization. If you cannot reach an agreement or do not agree to a new function (or other option), the company will have to try to force you to make a choice or to dismiss you via the UWV or the court.
