Division of property and zoning plan

Questioner

We have a house that is not technically split with the attached neighbor in terms of zoning plan. However, since 1976 they have been 2 houses with 2 separate house numbers. All municipal taxes are also paid separately. The same applies to gas, water and electricity. Does a limitation period apply to this?? I think I read that this is 25 years???

Lawyer

No, prescription cannot take place in the law that governs the situation on behalf of the municipality. However, there may be tolerance and at a certain point it serves legal certainty if the paper situation is adjusted to the actual situation, however, the municipality seems to apply that already. I can submit a request for my own house number.
