Missing parts on funeral budget
Questioner
As a surviving relative of the death of a parent, you will have to deal with a funeral director and prepare a budget/quote for the cremation. The funeral company makes a budget. But this budget does not include (consciously/unconsciously) costs that will later appear on the invoice. While the funeral company already knew when drawing up this budget that these costs would appear on the invoice anyway. This is far from neat. But is this legally possible? I had to sign the budget and apparently signed for this sentence that the funeral home came up with. 'The costs mentioned under 'Advanced to you (pro memoria items)' are based on assumptions and may differ from the final invoice, depending on the actual purchase of the services and units concerned'. It is not about the money, but whether this is legally possible and possible.Lawyer
Please check the terms and conditions to see if they mention such adjustments, as you must be able to take all cost items into account and agree to them in advance.Questioner
Dear Mrs. Ferwerda, Yarden indicates that they cannot determine the costs in advance. Therefore no quotation, but an estimate is discussed. Even if Yaren makes a mistake or leaves out items (consciously/unconsciously) in this estimate. Yarden states the following about this in the condition: ('The costs mentioned under 'Advanced for you (pro memoria items)' are based on assumptions and may, depending on the actual purchase of the services and units concerned, deviate from the final invoice'.) They have made many mistakes to our disadvantage. In the meantime this amounts to 615 euros. The debt appears to belong to the lady who arranged everything for us during the day. The lady did not process the budget we signed (15 minutes after the cremation) correctly in the computer, but we did not receive a copy of this on the day itself or afterwards.Lawyer
Based on the number of candidates I can still imagine an adjustment. But what falls under pro memoria services? Have they already been fulfilled, I assume so. And have you already paid? A specification is at least in order and also agreement with the various services.Questioner
Dear Mrs. Ferwerda, I have now contacted Yarden and indicated that I am in discussions with you. Then I received an email that Yarden lowered the invoice by 480 euros. An apology is not forthcoming, which is of course a shame, but also says something about the person who handled this. Although we find this a strange and unprofessional matter, we agree with it. Thanks for your help Yours sincerely, Mr. Martens.Lawyer
