Gym membership fee refund

Questioner

I pay my gym membership every 4 weeks. The gyms were closed for 4 weeks during the last lockdown, but my membership fees were debited. When I contacted the gym owner (where I asked to refund the amount of 30 euros, because I was unable to use his gym for the full 4-week term) he indicated that he did not need to do this because it was only 1 term. He also said that he had offered the possibility to borrow equipment. To what extent does he have the right (in view of the last point concerning 'lending') to write off my entire contribution?

Lawyer

During the lockdown, you were unable to use the gym's services. In the event of an alternative, it is important whether this is a reasonable alternative for you and whether you have been sufficiently informed about it. If you were not informed about the alternative, you were not able to use it. In addition, it is questionable whether that would have been a sufficient alternative for you. If it is not a fully-fledged alternative, it is probably not reasonable to demand the full contribution. It was common during the previous lockdown for subscriptions to be paused or for the price to be offset against, for example, the following month. You could also ask the gym to offset the costs against the following month. Please feel free to contact me via my profile if you have any questions or would like legal assistance.
