Threat of eviction from home
Questioner
Have been in this house for 17 years now. Due to temporary rent arrears, the landlord wants to evict me under the supervision of a number of men and replace the lock. Please advice on how to proceed. Rent commenced on the 15th of the month. On 10-12-2021 he sent a registered letter, received by me on 07-01-2022. In it he indicated that I had to be out on February 28th. However, last Friday the above-mentioned message regarding the men came by telephone. Please advise.Lawyer
In principle, a rental agreement can only be terminated through the intervention of a court if you do not agree with the notice of termination. Usually it has to be a three-month arrears (it can make a difference here whether you normally pay the rent in advance or not). If there is no court ruling, you cannot simply be evicted from the home under supervision. It is important to know exactly what kind of contract you have and what the situation is like (what kind of backlog do you have) before concrete advice can be given. I advise you in any case not to just agree to something and to look at the situation carefully.
