What should I do after company disappears after paying deposit for items?

Questioner

We made a deposit of €1950,- for solar panels in Nov 2021 with a company that has since (Jan. 2022) disappeared. I sent an email that I want to cancel the agreement. But what do I have to do legally to have a chance of getting my money back?

Lawyer

You can terminate an agreement if the agreement is not fulfilled. Usually you have to give the other party a period to fulfill the agreement. Should the company have fulfilled the agreement already (was a delivery date agreed)? Of course, it all becomes a bit more difficult if the company can no longer be found. Do you still have contact details of the company or the people you have been in contact with? You can summon the company to court. The losing party must in most cases pay the costs of the other party. In these cases it is often advisable to hire a lawyer. A letter from a lawyer often has a deterrent effect. A lawyer can often work (partly) on a 'no cure, no pay' basis. This means that you only have to pay (partly) if the result is positive.
