Right to transition compensation after 2 years of illness and 17 years of employment?
Questioner
I have been employed for 17 years and have been ill for almost 2 years now. The employer does not want me back because there are colleagues who used to be good friends of mine and eventually all broke off contact because of my illness. I seem to be too quiet and not as lively as I used to be (but hey, what do you expect with a 2-year depression) Now I have offered to work in June 2021 and I was told by my employer that the reintegration agency (2nd track) wants me to find another job. Now I am working on this but am I entitled to a transition payment? I mean 17 years of employment is not nothing and then I wanted to work in June 2021 and then he says no... the reason is and remains that the colleagues cannot deal with someone who is sometimes exuberant and sometimes in herself... I want to know if I am entitled to it because I am now simply being fobbed off by applying for a WIA to get rid of me in this way. I think it is strange... Yours sincerelyLawyer
Once the obligation to continue paying wages during illness has expired, the employer can in principle enter into a settlement agreement with you, in which it is customary to offer the statutory transition payment. You will of course lose your job. If the employer does not cooperate, this may be unlawful, as there is a statutory compensation scheme for him. Before you take action against the employer or sign anything, seek assistance and advice from an employment law specialist. You can contact me without obligation if you wish.
