My father's state pension has been cut
Questioner
My father's AOW pension was cut. Data from him from the period January 1970 to December 1975 has been lost. My father received a sickness benefit in the early 1970s because he became ill. Unfortunately, the data was lost (during digitisation) and the SVB can no longer access this data anywhere. According to them, my father lived abroad. My father was self-employed. When he was 65, he was asked to prove that he lived in the Netherlands with salaries etc. However, my father could not do this. His brother kept his administration and he has not kept anything anymore. Now, a few years have passed and the internet sometimes offers solutions. Now my mother wants to 'challenge' it again, but... my father passed away in 2013. Is this still possible or is it completely pointless?Lawyer
In principle, an objection must be filed within 6 weeks after a decision has been made (the deadline for filing an objection may have been different at the time). If no objection is filed, a decision is in principle final. However, a review of a decision can be requested, for example if new information has come to light or it has become clear that the decision was taken on the basis of incorrect information. In that case, it will usually be examined whether that information could have been available at the time. To request a review, there must be an interested party with an interest of their own. It is not stated in the story, but is it correct if I assume that a review of the decision could have financial consequences for your mother? I wouldn't dare say how likely this is based on the current information. Please feel free to contact me via my profile if you have any questions or wish to discuss the matter.Take the next step
