How do I record a loan to my mother?

Questioner

My father passed away last year and had no insurance for the funeral. Now I have lent my mother money for the funeral and do not have to pay it back during her lifetime. Her house is almost mortgage free so when she passes away there is enough money available to pay it off. How do you arrange something like that?

Lawyer

It is good that you are investigating the situation to avoid any future difficulties. Such a debt can be deducted from the inheritance. A loan agreement can be recorded in a number of ways: - By means of a notarial deed at the notary. This is then an official deed and inspection by a notary; - Have a private deed/agreement drawn up; - Drafting a private deed/agreement yourself. A notarial deed is not mandatory and the costs are considerably higher than having a private deed/agreement drawn up (or drawing it up yourself).
