Forced relocation from nursing home

Questioner

I am a mentor to a client with dementia in a nursing home. The nursing home wants to move my client to another care institution. The Flevohuis has experienced nuisance from the son and grandson, but that is not my client's fault. In my opinion, my client feels at home in the nursing ward and a transfer would be potentially harmful and in any case very undesirable. The nursing home claims that their decision was made with all due care and with consideration of all interests. I would like to have this legally tested, particularly in light of the recent move of my son and grandson elsewhere. I think that the risk of nuisance has therefore been greatly reduced. My client has a financial administrator who can apply for special assistance, etc.

You have a decision so yes you could object. If the client will be visited less or the visitors can adhere to certain specially drawn up rules (house rules) then the transfer can be called very unreasonable. Certainly in the light of an elderly mentally vulnerable patient.

Lawyer

Yes of course you can have that tested usually for a normal fee. A test is not done that easily because the decision must be studied for relevant case law and law. Otherwise, please contact me by email? info@rechtinjestad.nl
