Is dismissal via email valid?
Questioner
I work in primary education where it is currently a holiday. Last Monday I reported my resignation by phone and email to my manager and the foundation I work for. My manager indicates that my resignation will not be processed because of the holiday, which means I have to continue working for an extra month. Is this correct?Lawyer
Officially, dismissal is only submitted when the employer is informed of the dismissal. This can be done verbally, but also by email. What does your contract state about the time of termination or the manner of dismissal (sometimes a period of more than 1 month is agreed)? In principle, it is not about the time at which an email is processed, but about whether the employer/manager was informed of the dismissal within the period. If no one heard your email and/or telephone dismissal during the vacation, that could be a problem. But if the employer is aware, the dismissal is in principle valid.
