Which category of rental property?

Questioner

In October 2019, the court ruled that I could continue to live in my ex's home with my son. The monthly rent will be kept below the rent allowance limit as long as I continue to live in the home until July 14, 2026 at the latest (the date my son turns 23). My question is whether the house (despite the fact that it is a privately owned home that I have been renting since 2008) falls under the category of social housing because the rent is below the rent allowance limit or whether it falls under the private sector housing? This is because the rent was not allowed to be increased last year according to the annual indexation due to corona.

Lawyer

There is always social housing below the rent allowance limit, the judge decides for you because you are then entitled to rent allowance.

Questioner

Can the landlord not also rely on a points system for the property?

Lawyer

No, not if he or a judge has determined for him that the points system is suspended in your case. He can do that as soon as the house is rented to a new tenant.

Questioner

Good morning, I responded through your profile. Yours sincerely, Susanne Fortuin
